These Terms & Conditions (“Terms”) govern your access to and use of the kaizencoders.com website and the WordPress plugins and services provided by KaizenCoders (“KaizenCoders”, “we”, “us”, or “our”). By accessing our website, downloading a plugin, or purchasing a license, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Definitions

• “Services” — our website, free plugins, PRO plugins, and related support and updates.
• “Free Plugins” — plugins we distribute at no cost, including via WordPress.org.
• “PRO Plugins” — paid plugins or premium features available under a license.
• “You” — the individual or entity using the Services.

2. Use of our website

You agree to use the website lawfully and not to: attempt to gain unauthorized access; interfere with or disrupt the site or servers; scrape or harvest data by automated means without permission; or use the site to transmit malware or unlawful content.

3. Plugins and licenses

Free Plugins. Our free plugins are licensed under the GNU General Public License (GPL) v2 or later, consistent with WordPress. You may use, modify, and redistribute them under the terms of the GPL.

PRO Plugins. PRO Plugins and premium features are licensed, not sold. Subject to your payment and compliance with these Terms, we grant you a non-exclusive, non-transferable license to use the PRO Plugin on the number of sites permitted by your plan, for the duration of your active license. You may not resell, sublicense, or redistribute PRO Plugins except as permitted by their applicable license.

4. Purchases, payments, and renewals

PRO purchases are processed by our third-party payment and licensing provider. Prices are shown at checkout and may change over time. Where a subscription is offered, your license may renew automatically at the then-current price until you cancel. You can cancel renewals at any time before the next billing date; cancellation stops future charges but does not retroactively refund the current term except as described below.

5. Refunds

We want you to be satisfied. We offer a 14-day money-back guarantee on eligible PRO purchases: if the plugin does not work as described and we are unable to resolve the issue, you may request a refund within 14 days of purchase by contacting hello@kaizencoders.com. Refunds may be declined in cases of abuse or where the request falls outside this policy.

6. Support and updates

Support and updates for PRO Plugins are provided while your license is active. Free Plugin support is provided on a best-effort basis through public channels such as WordPress.org. We may modify, discontinue, or deprecate features over time.

7. Intellectual property

Except for Free Plugin code licensed under the GPL, all content, trademarks, logos, and materials on the website are owned by or licensed to KaizenCoders and are protected by applicable laws. The “KaizenCoders” name and product names are our trademarks and may not be used without permission.

8. Third-party services

Our Services may rely on or integrate with third-party services (for example, payment processing, analytics, and email delivery). Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services.

9. Disclaimer of warranties

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that they will meet your requirements.

10. Limitation of liability

To the maximum extent permitted by law, KaizenCoders shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim shall not exceed the amount you paid to us for the applicable product in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless KaizenCoders from any claims, damages, liabilities, and expenses arising from your misuse of the Services or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Services or a license if you breach these Terms. Upon termination, the rights granted to you will cease, though provisions that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will remain in effect.

13. Governing law

These Terms are governed by the laws applicable at KaizenCoders’ principal place of business, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the competent courts located there for any dispute arising out of or relating to these Terms.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
